Engineering Tomorrow, a Virginia nonstock corporation and 501(c)(3) nonprofit organization (“ET,” “we,” “our,” or “us”) is committed to protecting your privacy. This Privacy Policy explains our practices in connection with personal information we receive through our website, www.engineeringtomorrow.org (the “Website”); and to the services we provide to educational institutions and educators (the “Services”). 

1. PERSONAL INFORMATION WE COLLECT

We provide Services that schools and educators use for educational purposes, primarily for educating students. In connection with providing those Services, including in operating our Website, we may collect personal information about students and educators as described in greater detail below.

a. Sources of Information

ET collects information directly from students, educators, parents, and educational institutions when they submit requests or registration forms to us in connection with our Services. Additionally, when students, educators, or parents access our Website, we may automatically collect information about them through the use of “cookies” or similar technologies. ET may also, from time to time, work with service providers or data clearinghouses, such as the National Student Clearinghouse, to obtain information about students who previously participated in our Services for purposes of gauging the success of our programs.

b. Student Information

We collect the following information about students (collectively “Student Information”) when they use or submit information in connection with our Services or our Website and from our service providers: 

  • Contact information and identifiers, specifically first and last name, email address, and date of birth.
  • Education information and affiliations, specifically assigned ID number or other student ID number; district ID, state ID, or other identification of school, district, and similar information; grade level, scheduled courses, and similar course-related information; learning style; and teacher assignment.
  • Demographic data where authorized by a parent or guardian in the Student/Parent Registration Form.
  • Interactions with ET, specifically any student work that is submitted to us in connection with our Services and any interactions and correspondence between us such as calls made to our customer support services, emails or form submissions sent to us, online chat conversations with any customer support services, and any interactions with our representatives.
  • Internet and network activity, specifically IP address, type of browser, type of computer, device ID, geolocation, visits to our Website, and resources used and accessed on our Website. 

ET is a nonprofit educational organization and is therefore not a commercial operator under COPPA, nor an “educational agency” or other institution that receives U.S. Department of Education funding subject to FERPA or PPRA. However, because ET partners with schools that are subject to these laws, we voluntarily adhere to the principles and requirements of FERPA, COPPA, and PPRA when providing our programs and Services.

  • notify schools and, where requested, parents describing the types of personal information collected, how it is used, and with whom it is shared.
  • collect, maintain, and use Student Information only subject to the direction of the educational institution, and solely for purposes authorized by that institution.
  • delete and de-identify Student Information once it is no longer needed for the purpose for which it was collected or upon request of the educational institution.
  • seek to respect parents’ requests, made at any time directly to ET or through their child’s school, to review, correct, delete, or stop any further collection or use of their child’s information.
  • collect more information than is reasonably necessary for participation in the Services.
  • redisclose Student Information except as directed by the school or as permitted under FERPA.
  • engage in behavioral advertising, cross-site tracking, or the sale of personal data for monetary or other valuable consideration.
  • intend our Website for use by individuals under age 13. 
  • knowingly collect, use, process, or otherwise disclose information about children under age 13.
  • as part of our collection of Student Information or use of surveys about our Services, request information from students that would reveal: (1) political affiliations or beliefs; (2) mental or psychological problems; (3) sex behavior or attitudes; (4) illegal, anti-social, self-incriminating, or demeaning behavior; (5) critical views of individuals with whom students have a close relationship; (6) legally recognized privileged or analogous relationships; (7) religious practices or beliefs; or (8) income (unless required by law to determine eligibility for participation or financial assistance).

c. Educator Information 

We also collect the following personal information about educators (collectively, “Educator Information”) when they use our Services or our Website:

  • Contact information and identifiers, including name, email address, and other information that may be necessary to contact or identify an educator.
  • Professional information and affiliations, including what grade level the educator teaches and school or district affiliation, including district ID, state ID, or other identification of school, district, and similar information. 
  • Interactions with ET, including any interactions and correspondence between us such as calls made to our customer support services, emails or form submissions sent to us (which can include tracking information such as opening of emails, including through tools such as Gmass), online chat conversations with any customer support services, and any interactions parents or guardians may have with our representatives.
  • Internet and network activity that may relate to use of our Services or Website, including automatically collected information such as IP address, type of browser, type of computer, device ID, geolocation, interactions with communications including emails, visits to our Website, and resources used and accessed on our Website.

d. Other Individuals’ Information (including Parents/Guardians and Funders)

We also collect the following personal information about parents and guardians (collectively, “Parent/Guardian Information”) when they use our Services or our Website, including on behalf of a child or student in their care:

  • Contact information and identifiers, including name, email address, and other information that may be necessary to contact or identify a parent or guardian.
  • Student- or child-relationship information, including information regarding the relationship between the parent/guardian and the student or child that may be receiving our Services. 
  • Interactions with ET, including any interactions and correspondence between us such as calls made to our customer support services, emails or form submissions sent to us (which can include tracking information such as opening of emails, including through tools such as Gmass), online chat conversations with any customer support services, and any interactions educators may have with our representatives.
  • Internet and network activity that may relate to use of our Services or Website, including automatically collected information such as IP address, type of browser, type of computer, device ID, geolocation, interactions with communications including emails, visits to our Website, and resources used and accessed on our Website.

2. HOW WE USE PERSONAL INFORMATION

a. Use of Student Information

In accordance with our contractual obligations and applicable laws regarding Student Information, ET only uses Student Information:

  • As authorized by any applicable educational institution or agency;
  • To evaluate the success of our Services, including through use of Student Information to identify successful outcomes after our Services;
  • To provide and improve our Website and Services;
  • To protect or enforce legal obligations related to the Website or Services; 
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of ET, our customers, or others, including to protect the safety of a child, protect the safety and security of the Website, or enable us to take precautions against liability.
  • In the event of a sale, merger, or re-organization provided the information is used for the same purposes as set out in this Privacy Policy; and
  • To comply with applicable law.

b. Use of Non-Student Information

ET may use non-Student Information, including Educator Information and Parent/Guardian Information, for the same purposes as described above for Student Information as well as for the purposes in the list below and for any additional purpose that you consent to or that ET notifies you of at the time of collection. 

  • To provide our Services, including to enable you to request or provide feedback regarding our Services.
  • To provide and improve our Website, monitor usage, and promote our Services to you, including using tracking technologies and information collected through cookies to maintain and enhance the functionality of our Website, resolve technical issues, and provide targeted advertisements.
  • To communicate with you, including sending emails about our Services and corresponding with users when they request to receive more information or register for services. 
  • To comply with our legal obligations and enforce our rights, including seeking to comply with regulatory requirements, conduct audits, communicate with regulators, protect ET’s or a third party’s rights, and enforce our contracts, which may include disclosing your personal information to third parties such as attorneys, courts, or government entities. We may also disclose your information if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of ET, our customers, or others, including to protect the safety of a child, protect the safety and security of the Website, or enable us to take precautions against liability
  • In connection with a sale, merger, or reorganization of our business, if we undergo such a business transaction or change and need to transfer personal information in connection with due diligence or following a transaction or change.

3. WHO WE SHARE PERSONAL INFORMATION WITH 

a. Sharing Student Information

We do not sell, rent, or lease Student Information to third parties. If a student or educator uses our Services in connection with a particular educational institution or agency, we will provide the Educator Information and Student Information to the associated educational institution or agency. We share Student Information with our service providers as necessary to provide the Services, operate our Website, and for the purposes described above. We require all third parties that we share Student Information with to respect the security of Student Information and to treat it in accordance with the law and this Privacy Policy. We may also share Student Information with third parties if required by law or as part of legal proceedings or in connection with a sale, merger, or reorganization of our business. We only share Student Information as authorized by an educational institution or agency or by applicable law. 

Except as described in this Privacy Policy, ET will not knowingly disclose or authorize the disclosure of Student Information to any third party unless: (1) we have reason to believe that disclosing this information is necessary to identify, contact, or bring legal action against someone who may have breached the terms and conditions of our Website, or who may be causing injury to or inference with (either intentionally or unintentionally) ET’s rights or property, other Website users, or anyone else who could be harmed by such activities; (2) we believe in good faith that the law requires it; or (3) a parent or educator has consented to the disclosure.

b. Sharing Non-Student Information

We do not sell your personal information to third parties for money. When you interact with the Website, we may use or authorize third-party partners and service providers to use cookies, web beacons, and similar technologies to improve your experience with us. Our sharing of your personal information in this way may constitute “sharing,” “sale,” or “targeted advertising” under certain U.S. state privacy laws, and to the extent it is, we have shared in the preceding twelve (12) months or will share the following categories of personal information for business purposes: (1) identifiers and information about you; (2) internet or other similar network information; and (3) inferences and preference information. You may opt out of this sharing. We disclose personal information only when necessary to achieve the purposes described in this Privacy Policy, to support our legitimate business operations, or to meet our legal and regulatory obligations, and all third parties who receive personal information from us are required to protect it in accordance with applicable data protection laws and to process it only under our written instructions. We may disclose your personal information:

  • to third parties assisting us in carrying out the purposes for which the information was collected, including for purposes of: 
  • processing donations (such as through Stripe, a payment processor), 
  • managing our relationships with schools, districts, parents, teachers, donors, and others (such as through Salesforce, a customer relationship management platform),
  • tracking engagement with communications like emails (such as through GMass and MailChimp, which are email campaign platforms), 
  • fulfillment of requests for physical materials (such as through Salesforce and integrations with shippers or logistics platforms like UPS, Shippo, and Fishbowl), and 
  • Website usage analysis, improving Website function, and targeted advertising (such as through cookies and similar technologies provided by third parties like Google, LinkedIn, Meta, and our hosting provider); 
  • to any other person as specified at the point of collection and as otherwise set out in this Privacy Policy;
  • as you direct us or where you have consented to such disclosure;
  • to a buyer or other successor in the event of or during a merger, divestiture, restructuring, dissolution, or other sale or transfer of some or all of our assets or equity, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information is among the assets transferred;
  • to comply with any court order or legal obligation, including responding to any lawful government or regulatory request, or if we believe disclosure is necessary to enforce or protect our rights, property, safety, or that of our users or third parties. We may make your information available to third parties assisting us in fulfilling the purposes for which we collected your information. 

4. INFORMATION ABOUT COOKIES AND TRACKING TECHNOLOGIES

You can learn more about our how we use cookies and other data collection technologies (for purposes of this Privacy Policy, referred to collectively as “cookies”) in our Cookie Policy. You can adjust your preferences for how you interact with cookies on our website by: using our Consent Preferences; configuring your browser settings to refuse cookies or notify you before placing them; or enabling the Global Privacy Control (“GPC”), a “do-not-track” signal that our Website is configured to recognize and respond to (although, at this time, we are unable to recognize and respond to all do-not-track signals). For more information or to make a request relating to our use of cookies, you can contact us using the methods below (in addition to reviewing the Cookie Policy or using the Consent Preferences).

5. RETENTION PERIODS

Our retention periods for personal information are based on business needs and legal requirements. We will retain your personal information for only as long as necessary to fulfill the educational purpose authorized by the school or as required by law. After Services conclude, ET may de-identify Student Information by removing names, contact details, and any other elements that could reasonably identify an individual. ET may retain and analyze de-identified or aggregated data for legitimate educational and research purposes, such as assessing the long-term impact of our programs, improving curricula, and reporting outcomes. 

If ET seeks to use identifiable Student Information for any new purpose beyond the original educational use authorized by the school, ET will do so only under a new written agreement with the educational institution or with appropriate consent. When data is no longer needed for these purposes, ET securely deletes or irreversibly anonymizes them.

6. PRIVACY RIGHTS

You may have certain rights relating to your personal information, subject to local data protection laws. Depending on the applicable laws and under certain conditions, individuals may have the right to: ask us to provide them with further details or a brief summary on how we use and process personal information; ask us to provide them with a copy of their personal information that we hold; ask us to update any inaccuracies in their personal information we hold; ask us to delete their personal information we no longer have grounds to process; ask us to electronically transmit their personal information to a third party; restrict how we process their personal information while we consider an inquiry they have raised; and make a complaint to their local government or regulatory authority related to their privacy rights. These rights are subject to certain exemptions, including without limitation, to safeguard the public interest and our interests.

To request to exercise any privacy rights described above, please submit a request to us by:

Only the individual themselves, or a person or entity that they authorize to act on their behalf, may make a verifiable request related to the individual’s personal information. Parents or guardians of students under eighteen (18) may exercise the rights to access, review, and request correction or deletion of their child’s personal information collected through ET’s Services. If someone makes a request on behalf of another person, they may be required to provide written legal documentation that they are authorized to act on behalf of that other individual. We may not be able to fulfill a request or provide personal information if we cannot verify a requestor’s identity or authority to make the request. To verify a requestor’s identity, we may request up to three (3) pieces of personal information about the requester, and we reserve the right to take additional steps as necessary to verify a requestor’s identity if we have reason to believe a request is fraudulent. We seek to respond to most requests within one (1) month.

We do not use automated decision-making technologies to make decisions with legal or similarly significant effects.

7. LINKS TO OTHER WEBSITES

Users may be linked or directed to other third-party websites that are beyond ET’s control while using our Website or Services. Each of these third parties may have a privacy policy different from that of ET. ET is not responsible for any actions or policies of such third parties. Users should review the applicable privacy policies of these third-party websites before providing personal information to those third parties.

8. SECURITY AND STORAGE

We maintain an appropriate security program with administrative, technical, and physical safeguards consistent with federal student data privacy requirements and designed to protect personal information that we collect and hold. Unfortunately, no data transmission (both over the internet or otherwise) can be guaranteed to be 100% secure. As a result, while we strive to protect personal information, we cannot guarantee the security of any information that is provided to us. 

Please note that all personal information we collect is stored by us in the United States. 

9. CHANGES TO THESE TERMS

We may change this Privacy Policy from time to time and if we make material changes to this Privacy Policy, we will change the date at the beginning of this Privacy Policy, and either post notices on this page (or the page on which this Privacy Policy is found) or take other steps reasonably designed to provide individuals with notice of the changes.
